Caregiver Marketplace Agreement
Effective Date: October 6, 2026 · Last Updated: October 6, 2026
Purpose. This agreement governs caregivers who create profiles, accept bookings, or provide care services through the Connect-4Care marketplace. It supplements the Connect-4Care Terms of Service and Privacy Policy.
1. About Connect-4Care
Connect-4Care operates an online marketplace that enables families and individuals seeking care ("Care Seekers") to discover, communicate with, and book independent caregivers ("Caregivers").
Connect-4Care provides technology and marketplace functions that may include:
Caregiver profiles and search tools;
scheduling and messaging;
booking functionality;
identity verification and background-screening features;
payment processing;
ratings and reviews;
customer support; and
other tools designed to facilitate connections between Caregivers and Care Seekers.
Except where applicable law requires otherwise, Connect-4Care does not employ Caregivers, assign Caregivers to clients, or direct the day-to-day manner in which Care Services are performed.
Nothing in this Agreement is intended to avoid, waive, or modify any obligation imposed on Connect-4Care or a Caregiver under federal, state, or local law.
2. Agreement to These Terms
This Caregiver Marketplace Agreement ("Caregiver Agreement") is entered into between Connect-4Care ("Connect-4Care," "Company," "we," "us," or "our") and the individual registering to offer caregiving services through the Connect-4Care Platform ("Caregiver," "you," or "your").
By creating a Caregiver profile, accepting this Agreement electronically, accepting a booking, or providing services through the Platform, you agree to this Caregiver Agreement and the Connect-4Care Terms of Service. If you do not agree, you may not offer Care Services through Connect-4Care.
3. Caregiver Eligibility
To maintain a Caregiver account, you must:
be at least eighteen (18) years old;
have the legal right to provide the services you offer;
provide accurate identity and contact information;
complete applicable identity-verification requirements;
satisfy applicable background-screening requirements;
accurately represent your experience, qualifications, licenses, certifications, and training;
maintain any legally required license, certification, permit, registration, or insurance;
comply with applicable federal, state, and local laws; and
satisfy any additional eligibility requirements disclosed by Connect-4Care.
Connect-4Care may require updated information or reverification from time to time.
4. Independent Marketplace Relationship
Except where applicable law determines otherwise, the parties intend for Caregivers using Connect-4Care to operate independently and not as employees of Connect-4Care.
Subject to Platform functionality and applicable law, Caregivers generally control:
whether to make themselves available for bookings;
the days and times they are available;
the geographic areas in which they choose to provide services;
which booking requests they accept or decline;
the services they are willing and qualified to provide; and
their rates where rate-setting functionality is available.
Connect-4Care does not guarantee any minimum number of bookings, hours, clients, or earnings. Caregivers are free to provide services through other platforms or independently, subject to their obligations concerning bookings and relationships initiated through Connect-4Care.
Caregivers are not entitled to employee benefits from Connect-4Care, including paid vacation, paid sick leave, retirement benefits, health insurance, unemployment benefits, or workers' compensation coverage, except where required by law.
The description of the relationship in this Agreement does not determine legal worker classification where applicable law requires a different classification. Legal classification depends on the actual circumstances of the relationship.
5. Caregiver Profile
Your Caregiver profile must be truthful, accurate, and kept current. You may be asked to provide information including:
name and photograph;
geographic service area;
availability;
experience and biography;
education and languages;
certifications and professional licenses;
CPR or first-aid training;
services offered;
transportation availability;
references;
rates; and
other information relevant to Care Seekers.
You may not falsify your experience, claim credentials you do not possess, use another person's identity or credentials, misrepresent your professional status, falsely claim to be employed by Connect-4Care, or provide information you know to be materially misleading.
Connect-4Care may request documentation supporting profile claims.
6. Caregiver Services
Caregivers may make themselves available for categories of services supported by Connect-4Care, which may include:
Personal & Daily Care;
Companionship & Connection;
Meals & Home Support;
Mobility & Physical Support;
Cognitive Support;
Respite & Overnight Care;
Specialized Care;
Errands & Outings; and
other services permitted by the Platform.
The appearance of a service category on Connect-4Care does not mean that every Caregiver is qualified or legally permitted to perform every service within that category.
You may offer and perform only services that you are legally permitted, appropriately trained, competent, and reasonably capable of performing.
7. Medical, Nursing, and Regulated Services
A Caregiver may not perform nursing, medical, clinical, medication-administration, or other professionally regulated services unless legally authorized and appropriately licensed or credentialed to do so.
Caregivers must comply with all applicable scope-of-practice rules and must never represent themselves as a registered nurse, licensed practical nurse, certified nursing assistant, medical professional, therapist, medication aide, or other licensed or credentialed professional unless they currently possess the applicable credential.
Possession of a healthcare credential does not authorize a Caregiver to perform every healthcare-related activity in every setting. Caregivers are personally responsible for understanding and complying with the legal limits applicable to the services they choose to offer.
8. No Guarantee of Bookings
Creating a Caregiver account does not guarantee that you will receive bookings. Connect-4Care does not guarantee:
a minimum number of Care Seekers;
a minimum number of bookings;
minimum working hours;
minimum earnings;
continued availability of the Platform;
placement with any particular Care Seeker; or
that Care Seekers will select your profile.
Care Seekers independently decide which Caregiver they wish to contact or book.
9. Accepting Bookings
You are not required to accept every booking request.
Before accepting a booking, you should review the available information concerning requested services, Care Recipient needs, date, start and end times, location, mobility or accessibility needs, transportation requirements, pets or household conditions, special instructions, and any other information reasonably necessary to determine whether you can safely and appropriately perform the booking.
By accepting a booking, you represent that you reasonably believe you can perform the requested services safely, lawfully, and competently. If information provided by a Care Seeker is insufficient, you should request clarification before accepting the booking.
10. Caregiver Responsibility During Bookings
For every accepted booking, Caregivers agree to:
arrive at the agreed location at the agreed time;
provide only the agreed services;
behave professionally and respectfully;
protect the dignity and privacy of the Care Recipient;
follow reasonable household instructions that do not conflict with law, safety requirements, or this Agreement;
avoid conduct that could reasonably endanger the Care Recipient or others;
promptly communicate material problems affecting the booking;
accurately report hours or services when required through the Platform;
avoid leaving a Care Recipient in an unsafe situation;
comply with mandatory reporting obligations applicable to them; and
contact emergency services when reasonably necessary.
11. Caregiver Platform Fee
Connect-4Care currently charges Caregivers a 5% Platform Fee on amounts earned through qualifying bookings made through Connect-4Care.
The Platform Fee helps support marketplace technology, payment infrastructure, customer support, communications, verification features, and marketplace operations.
The applicable fee will be displayed or otherwise disclosed through the Platform. Connect-4Care may change its Platform Fee prospectively by providing notice as required by law. A changed fee will not retroactively alter fees applicable to completed bookings.
12. Payments and Payouts
Payments for bookings arranged through Connect-4Care must be processed through the approved Connect-4Care payment system unless expressly authorized otherwise.
Connect-4Care may use third-party payment processors, including Stripe Connect, to facilitate payments and Caregiver payouts.
You agree to provide information required by the payment processor, which may include legal name, address, date of birth, taxpayer information, banking information, identity documents, and other verification information.
Caregiver earnings are generally calculated based on completed bookings, less applicable Platform Fees, refunds, adjustments, chargebacks, or other amounts permitted under this Agreement or applicable law.
Displayed payout timing is an estimate and may be affected by bank processing times, weekends or holidays, identity verification, payment reviews, fraud prevention, chargebacks, payment disputes, banking errors, or payment-processor delays. Connect-4Care does not guarantee that every payout will arrive within a particular number of hours or days.
13. Taxes
Caregivers are responsible for understanding and satisfying their own federal, state, and local tax obligations relating to income earned through Care Services, except to the extent Connect-4Care is legally required to withhold or remit taxes.
Where required by law, Connect-4Care or its payment provider may collect taxpayer information and issue applicable tax forms. Caregivers are responsible for maintaining their own financial and tax records. Connect-4Care does not provide individual tax advice.
14. Caregiver Expenses
Unless expressly stated otherwise, Caregivers are responsible for their own ordinary expenses incurred in providing Care Services, including transportation, fuel, mobile phones, clothing, personal supplies, insurance, licensing, certifications, continuing education, equipment, and taxes.
Care Seekers and Caregivers may separately agree regarding reimbursement of particular booking-related expenses when permitted through the Platform. Caregivers must not make unauthorized purchases using a Care Recipient's money or payment information.
15. Background Checks
Connect-4Care may require or facilitate background screening through a qualified third-party screening provider, including Checkr or another provider selected by Connect-4Care.
Where the Fair Credit Reporting Act or another law applies, any required disclosure and authorization for a consumer report will be presented separately from this Caregiver Agreement. Acceptance of this Agreement by itself is not intended to serve as the legally required standalone authorization where separate authorization is required.
Caregivers must complete applicable screening steps honestly. A background check is not necessarily continuous and may represent information available from specified sources as of a particular date. Connect-4Care may require periodic rescreening where permitted by law.
16. Background Check Badges
16.1 Verified Background Check
A "Verified Background Check" badge indicates that Connect-4Care or its designated screening provider facilitated or obtained a background screening using Connect-4Care's then-current screening process. A badge does not guarantee suitability or future conduct.
16.2 Background Check Provided
A "Background Check Provided" badge indicates that the Caregiver provided background-check documentation or information for consideration. This is different from a Verified Background Check.
Unless Connect-4Care expressly states otherwise, Connect-4Care does not represent that every item within a caregiver-provided report has been independently verified by Connect-4Care. Caregivers may not falsify, alter, manipulate, or misrepresent screening documentation.
17. Safety Information and Changes in Status
Caregivers must promptly notify Connect-4Care if information materially affecting their eligibility or ability to safely provide Care Services changes. Examples may include:
suspension or loss of a required professional license;
suspension or loss of a driver's license when transportation services are offered;
inability to maintain legally required insurance;
criminal charges or convictions where legally relevant;
restrictions affecting professional practice;
identity-verification problems; or
other circumstances that materially affect the Caregiver's lawful eligibility to perform services offered through the Platform.
Connect-4Care will handle such information in accordance with applicable law and its Privacy Policy.
18. Emergencies
CONNECT-4CARE IS NOT AN EMERGENCY MEDICAL SERVICE.
If you reasonably believe a Care Recipient or another person is experiencing a medical emergency or immediate threat to health or safety, call 911 or the appropriate local emergency service first.
Do not delay emergency assistance while attempting to contact Connect-4Care. After immediate safety needs have been addressed, you should notify the Care Seeker and Connect-4Care as reasonably appropriate.
19. Changes in a Care Recipient's Condition
Caregivers should promptly communicate material changes or concerns observed during a booking to the Care Seeker or appropriate responsible party. Caregivers should not independently diagnose medical conditions.
If the Care Recipient's needs exceed your qualifications, ability, or lawful scope of practice, you should not attempt services you are not qualified to perform. If continued service cannot safely be provided, take reasonable steps to protect the Care Recipient from immediate harm and contact the appropriate responsible party or emergency services.
20. Abuse, Neglect, Exploitation, and Safety Concerns
Connect-4Care has zero tolerance for abuse, neglect, exploitation, theft, violence, harassment, or intentional mistreatment of a Care Recipient.
Caregivers must comply with any mandatory-reporting law applicable to their role, profession, or circumstances. Suspected immediate danger should be reported to appropriate emergency or protective authorities. Caregivers should also report serious safety incidents involving a Connect-4Care booking to Connect-4Care.
21. Medications
Caregivers may only provide medication-related assistance that they are legally permitted and appropriately qualified to provide.
Caregivers must not independently prescribe medication, independently change dosage, make medical decisions regarding whether medication should be started or discontinued, or perform medication administration requiring a professional license they do not possess.
When uncertain about whether an activity is legally permitted, the Caregiver should not perform the activity until appropriate guidance is obtained.
22. Transportation
A Caregiver who offers transportation must:
possess a valid driver's license appropriate for the vehicle being operated;
operate a legally registered vehicle;
maintain automobile insurance required by applicable law;
comply with applicable traffic and safety laws;
immediately disclose any change that makes the Caregiver legally unable to transport Care Recipients; and
never drive while impaired.
Connect-4Care does not own, maintain, inspect, or insure independently owned Caregiver vehicles unless expressly stated otherwise. Caregivers are responsible for determining whether their automobile insurance appropriately covers the transportation activities they choose to provide.
23. Home Access, Property, and Financial Information
Caregivers may receive temporary access to residences, keys, alarm codes, door codes, vehicles, personal property, grocery funds, payment cards, medications, or confidential information. Such access may be used only for the purpose authorized by the Care Seeker or Care Recipient.
Caregivers may not retain keys after authorization ends, duplicate keys without permission, share entry codes, use financial information for personal purposes, borrow money from a Care Recipient, solicit gifts through pressure or manipulation, take possession of property without authorization, or access areas or information unrelated to the agreed Care Services.
Theft, financial exploitation, or unauthorized use of property may result in immediate removal from the Platform and referral to law enforcement.
24. Gifts and Personal Financial Relationships
Caregivers should maintain appropriate professional boundaries with Care Recipients.
Caregivers may not use their caregiving relationship to pressure or manipulate a Care Recipient into providing money, loans, large gifts, access to financial accounts, property, inclusion in a will or estate plan, or other substantial financial benefits.
Nothing in this section prohibits ordinary small expressions of appreciation where lawful and freely given, but Connect-4Care may review circumstances involving significant transfers of value.
25. Privacy and Confidentiality
During Care Services, Caregivers may learn private information concerning Care Recipients and their families. Caregivers agree to protect such information and use it only as reasonably necessary to perform the applicable Care Services.
Caregivers may not improperly disclose medical information, family information, addresses, financial information, photographs, access codes, private conversations, identifying information, or other confidential information.
Caregivers may not photograph, record, livestream, or post images or information about a Care Recipient on social media without appropriate authorization. These obligations continue after a booking ends.
26. Communications
Caregivers agree that Connect-4Care may send account and transactional communications concerning booking requests, booking confirmations, booking changes, Care Seeker messages, payments, payouts, account security, verification, safety matters, customer support, and other Platform operations.
Where required by law, marketing communications will be subject to separate consent and applicable opt-out rights. Caregivers are responsible for maintaining accurate contact information.
27. Cancellations, Late Cancellations, and Care Seeker No-Shows
Connect-4Care recognizes that Caregivers may reserve time for a confirmed booking and may lose other work opportunities when a Care Seeker cancels at the last minute. At the same time, any cancellation charge or Caregiver compensation is subject to applicable law.
The following policy applies unless a different rule is disclosed before booking or applicable law requires a different result:
27.1 More Than 24 Hours Before the Scheduled Start Time
If a Care Seeker cancels more than twenty-four (24) hours before the scheduled start time, the Caregiver generally will not receive cancellation compensation for services not performed.
27.2 Between 2 and 24 Hours Before the Scheduled Start Time
If legally permitted, when a Care Seeker cancels between two (2) and twenty-four (24) hours before the scheduled start time, the Caregiver will generally be eligible to receive 50% of the scheduled Caregiver compensation for the cancelled booking, less the normal Connect-4Care Caregiver Platform Fee and any legally permitted adjustments.
27.3 Less Than 2 Hours Before the Scheduled Start Time, Caregiver Already Traveling, or Care Seeker No-Show
If legally permitted, when a Care Seeker cancels less than two (2) hours before the scheduled start time, the Caregiver has already reasonably begun traveling to the booking, or the Care Seeker is unavailable and the Caregiver cannot reasonably begin the confirmed booking, the Caregiver will generally be eligible to receive an amount up to 100% of the Caregiver compensation for the first two (2) scheduled hours of the booking, less the normal Connect-4Care Caregiver Platform Fee and any legally permitted adjustments.
This provision is intended to compensate for reserved time and late cancellation losses without automatically charging a Care Seeker for the entire value of a long booking that was not performed.
27.4 Emergencies and Extraordinary Circumstances
Connect-4Care may waive, reduce, or adjust a cancellation charge or related Caregiver compensation when reasonably appropriate, including in circumstances involving hospitalization, death, severe weather, evacuation, documented emergencies, or other extraordinary events.
27.5 Applicable Law Controls
If a law, regulation, licensing requirement, regulatory interpretation, or government directive applicable to a booking limits or prohibits a cancellation charge or requires a different calculation, that law or requirement controls. Connect-4Care will assess and distribute only amounts that it is legally permitted to charge or pay.
Caregiver compensation for a Care Seeker cancellation is governed by Connect-4Care's then-current Cancellation and Refund Policy, the booking terms disclosed through the Platform, and applicable law.
28. Caregiver Cancellations
Caregivers should accept bookings only when they reasonably expect to fulfill them.
If you must cancel a confirmed booking, you agree to:
cancel through the Platform when possible;
provide as much notice as reasonably possible;
communicate promptly with the Care Seeker; and
avoid repeatedly accepting bookings you cannot fulfill.
If a Caregiver cancels before providing the scheduled services, the Caregiver will not be paid for services not performed. The Care Seeker will be eligible for a full refund for the cancelled, unperformed booking, including the applicable Connect-4Care family service fee associated with those unperformed services, subject to applicable payment-processing and legal requirements.
Connect-4Care may attempt to help the Care Seeker locate another Caregiver but does not guarantee replacement coverage. Repeated, last-minute, or inappropriate Caregiver cancellations may affect account standing or Platform access. Legitimate emergencies or circumstances outside the Caregiver's reasonable control may be considered when Connect-4Care reviews cancellation patterns.
29. Late Arrivals and Caregiver No-Shows
Caregivers are expected to arrive for confirmed bookings at the agreed time. If you expect to be late, you must notify the Care Seeker as promptly as reasonably possible.
Failure to appear for a confirmed booking without reasonable notice may be treated as a no-show. Repeated no-shows or serious attendance problems may result in booking restrictions, suspension, or termination of Platform access.
30. Off-Platform Bookings and Fee Avoidance
Connect-4Care invests in technology, verification, communications, payment infrastructure, safety systems, customer support, and other features that allow Caregivers and Care Seekers to connect.
A Caregiver may not intentionally use Connect-4Care to identify or connect with a Care Seeker and then move bookings resulting from that introduction outside the Platform for the purpose of avoiding applicable Connect-4Care fees or requirements.
If a Care Seeker asks you to move a Connect-4Care booking off-platform to avoid Platform fees or protections, you should decline. This section is intended to prevent intentional circumvention of the marketplace and is not intended to prohibit activity that cannot lawfully be restricted.
31. Ratings and Reviews
Care Seekers may have the opportunity to rate or review Caregivers. Caregivers may also have opportunities to provide feedback regarding Care Seekers.
Ratings and reviews must comply with Connect-4Care policies. Connect-4Care does not guarantee that every review will be positive. Connect-4Care may remove reviews that it reasonably determines violate Platform policies, but it is not obligated to remove a review simply because a Caregiver disagrees with it.
Caregivers may not manipulate reviews, create false reviews, retaliate against users for lawful reviews, or offer improper incentives in exchange for favorable ratings.
32. Prohibited Conduct
Caregivers may not engage in:
abuse, neglect, or exploitation;
theft or fraud;
harassment, threats, or violence;
unlawful discrimination;
sexual misconduct;
falsification of credentials or booking records;
impairment while providing care;
unauthorized use of medication;
unlawful possession or use of controlled substances;
intentional misuse of Care Recipient funds;
misuse of confidential information;
unsafe transportation practices;
illegal activity;
retaliation against a Care Seeker; or
conduct that creates a serious safety risk.
33. Professional Boundaries
Caregivers must maintain reasonable and appropriate boundaries with Care Recipients and families.
Caregivers must not exploit dependency, cognitive impairment, loneliness, disability, financial vulnerability, or access obtained through the caregiving relationship for personal, romantic, sexual, financial, or other improper purposes.
34. Personal Supplies and Equipment
Unless otherwise agreed, Caregivers are responsible for ordinary personal items necessary for their work.
Caregivers must use reasonable care when operating equipment provided by the Care Seeker or Care Recipient. A Caregiver should not use medical or mobility equipment they do not know how to operate safely.
35. Insurance
Caregivers are responsible for determining what insurance is appropriate for the services they independently provide. Where insurance is required by law, Caregivers must maintain that coverage.
Connect-4Care may require evidence of particular insurance for certain services, categories, or Platform features. Connect-4Care does not represent that its own insurance, if any, provides personal coverage to an individual Caregiver for every incident or claim.
36. No Authority to Bind Connect-4Care
Caregivers may not enter contracts on behalf of Connect-4Care, make promises on behalf of Connect-4Care, represent themselves as Connect-4Care employees, incur expenses on behalf of Connect-4Care, or represent that Connect-4Care has approved or guaranteed services beyond statements expressly made by Connect-4Care.
37. Platform Standards vs. Control of Care Services
Connect-4Care may establish rules concerning use of its Platform, including rules addressing account verification, safety, fraud prevention, payments, communications, conduct, profile accuracy, booking reliability, privacy, and marketplace integrity.
Such Platform standards are intended to govern participation in Connect-4Care and do not, by themselves, give Connect-4Care control over the manner and means by which an independent Caregiver performs Care Services, except where supervision or control is required by applicable law.
38. Account Review, Suspension, and Termination
Connect-4Care may review, restrict, suspend, deactivate, or terminate a Caregiver account when reasonably necessary, including when:
eligibility requirements are no longer satisfied;
a background-screening requirement is not satisfied;
identity cannot be verified;
credentials are false or materially misleading;
a license or certification required for offered services expires or is restricted;
there is a credible safety concern;
the Caregiver violates this Agreement or the Terms of Service;
fraud or payment misuse is suspected;
the Caregiver repeatedly fails to honor bookings;
the Caregiver engages in prohibited off-platform circumvention;
required payment-account information is incomplete;
law or regulatory requirements require action; or
continued Platform access presents material risk to users or Connect-4Care.
Where required by applicable law, Connect-4Care will follow legally required notice or adverse-action procedures. A temporary suspension while a safety, verification, or regulatory matter is reviewed does not necessarily mean that Connect-4Care has concluded that misconduct occurred.
39. Regulatory or Licensing Changes
Healthcare, home-care, marketplace, worker-classification, and professional-practice requirements may change or may be interpreted differently by regulatory authorities.
If a regulatory agency determines that Connect-4Care or Caregivers using the Platform are subject to additional licensing, supervision, training, recordkeeping, service-plan, credentialing, or operational requirements, Connect-4Care may modify Platform operations or Caregiver requirements as reasonably necessary to comply with law.
Such changes may include requiring additional credentials, limiting certain service categories, requiring additional documentation, implementing training or competency requirements where legally required, changing booking procedures, adding supervisory processes where legally required, temporarily pausing certain services, restricting services geographically, or updating this Agreement.
Connect-4Care will provide notice of material changes when required by law.
40. Caregiver Records
Caregivers are responsible for providing accurate records or confirmations required through the Platform.
Caregivers may not intentionally falsify hours worked, services provided, booking start or end times, travel information, expenses, incident reports, credentials, or other information submitted through Connect-4Care.
Where law requires additional documentation for specific Care Services, Caregivers must cooperate with applicable documentation requirements.
41. Incident Reporting
Caregivers should promptly report serious incidents occurring during a Connect-4Care booking. Examples include:
medical emergencies;
falls resulting in injury;
hospitalization;
missing persons;
suspected abuse or exploitation;
significant property damage;
theft allegations;
vehicle accidents involving a Care Recipient;
violence;
law-enforcement involvement; or
other events presenting a substantial safety concern.
Reporting an incident to Connect-4Care does not replace contacting 911, Adult Protective Services, law enforcement, a healthcare provider, or another authority when reporting to that authority is necessary or legally required.
42. User Disputes
A dispute between a Caregiver and a Care Seeker regarding Care Services is primarily a dispute between those users.
Connect-4Care may assist with communications, payment records, or Platform information but is not obligated to act as an arbitrator. Connect-4Care may separately make decisions concerning Platform access, refunds, payment adjustments, safety, or account status as permitted by its policies and applicable law.
43. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Connect-4Care and its affiliates, owners, directors, officers, employees, agents, and service providers from third-party claims, liabilities, damages, losses, judgments, costs, and reasonable attorneys' fees arising from or relating to:
Care Services you provide;
your violation of this Agreement;
your violation of applicable law;
your negligence or misconduct;
your violation of another person's rights;
false or misleading information you provide;
services performed outside your lawful scope of practice;
your tax obligations;
your licensing or certification obligations; or
your use of property, vehicles, or equipment in connection with Care Services.
This section applies only to the maximum extent permitted by applicable law.
44. Limitation of Connect-4Care Liability
The limitation-of-liability provisions contained in the Connect-4Care Terms of Service are incorporated into this Agreement.
Connect-4Care does not guarantee any particular amount of Caregiver income, any minimum number of Care Seekers, the conduct of Care Seekers, the accuracy of every statement made by another user, continuous Platform operation, or that every dispute will be resolved in a Caregiver's favor.
Nothing in this Agreement limits liability that cannot legally be limited.
45. Term and Termination
This Agreement begins when you accept it or begin using Connect-4Care as a Caregiver. It continues until terminated by you or Connect-4Care.
You may stop using the Platform and close your Caregiver account, subject to outstanding bookings, payment obligations, investigations, chargebacks, pending disputes, and obligations that survive termination.
Sections that by their nature should continue after termination - including confidentiality, payment obligations, tax obligations, indemnification, intellectual property, and dispute provisions - will survive.
46. Changes to This Agreement
Connect-4Care may modify this Agreement from time to time. Material changes will be communicated when required by applicable law. The revised Agreement will identify its updated effective date.
Continued use of the Caregiver Platform after an updated Agreement takes effect may constitute acceptance to the extent permitted by law.
47. Relationship to the Terms of Service
The Connect-4Care Terms of Service and Privacy Policy are incorporated into this Caregiver Agreement.
If a provision of this Agreement directly conflicts with a general provision of the Terms of Service regarding a matter specific to Caregivers, this Caregiver Agreement will control with respect to that Caregiver-specific matter.
48. Governing Law
This Agreement is governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
Unless prohibited by applicable law, legal proceedings arising under this Agreement shall be brought in a court of competent jurisdiction in the Georgia county where Connect-4Care maintains its principal place of business.
49. Severability
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions will continue in effect. The invalid provision will be enforced to the maximum extent legally permissible or severed where necessary.
50. Entire Agreement
This Caregiver Agreement, together with the Terms of Service, Privacy Policy, applicable booking policies, Cancellation and Refund Policy, and any additional terms expressly incorporated into them, constitutes the agreement governing the Caregiver's use of Connect-4Care.
51. Electronic Acceptance
